The Laws in regards to the Workers Compensation Act of British Columbia can be confirmed at; www.worksafebc.com

 

Article 108, It is the duty of the provincial and federal governments to enforce the Workers Compensation Act. Let me spell that out in a direct quote.

 the Provincial government and every agency of the Provincial government,

(b) every employer and worker whose occupational health and safety are ordinarily within the jurisdiction of the Provincial government, and

(c) the federal government, every agency of the federal government and every other person whose occupational health and safety are ordinarily within the jurisdiction of the Parliament of Canada, to the extent that the federal government submits to the application of this Part.

 

The Governor General has the duty under the WC Act article 108 and the authority under the British North America Act, 187, section 143

 

British North America Act 1867

Section 143, The Governor General in Council may from Time to Time order that such and so many of the Records, Books and Documents of the Province of Canada as he thinks fit shall be appropriated and delivered either to Ontario or to Quebec, and the same shall thenceforth be the Property of that Province; and any Copy thereof or Extract therefrom, duly certified by the Officer having charge of the Original thereof, shall be admitted as Evidence.

 The issues here are, that no government or agent, (federal or BC. provincial), have initiated procedures to acquire documents as required under the Workers Compensation Act. Documents which would clearly show that there was an extreme risk of sever injury or death to the general public and employees. This denies the general public and employees the right to Security of person as guarantied under the Canadian Charter of Rights.

 

 Can you intervene on these issues or inform me of the appropriate agency that can?

 

 You should have received an email transmission just prior to receiving this one. That letter was addressed to the Rt. Honorable Vic Toews, Minister of Justice and is pasted at the end of this letter. This letter with additional letters as well as:

 I am writing again in regards to my concerns of violations of the Workers Compensation Act by the British Columbian and Federal Governments. I would like to point out that, violations of Occupational Health and Safety rules and regulations by an employee are not concerns that one would normally take before the British Government or the Throne. However governments not upholding the Rights of a Citizen are.

 

 Mr. G. Pilon has informed me that you can not comment or intervene in individual cases. I do not believe that applies in regards to the Workers Compensation Act, Article 108, Subsection c. Found at: www.worksafebc.com      

 

 I do not require for you to make comments but if you can, can you intervene to acquire, documents to show that Occupational Health and Safety Rules and Regulations were not complied with as I well know, (I was there), If you can not, then a referral to addresses and contact personal to the British Government or the Throne as I clearly have documents that show nether the British Columbia Government or the Federal Government have taken actions to do so. That would clearly show that no level of government has upheld my rights under the Occupational Health and Safety Rules and Regulations or the Workers Compensation Act of British Columbia.

 

 Documents must be produce to show compliance with Occupational Health and Safety Rules and Regulations by the employer In accordance with the Workers Compensation Act, Article 179, Subsection g. The workers Compensation Board has the DUTY to acquire those documents under the Workers Compensation Act, Board Mandate, Article 111, Sections 1 & 2, Subsections a & b. The provincial and federal governments hold responsibilities under the WC. Act as well, Article 108, Subsections a, b, & c.

As a Certified Member of: the Industrial First Aid Attendants Association, Registration # 11136, my complaint should have been dealt with immediately.

Hydro Employees would not so much as pass wind on a job site if all documents are not in order. If they did then they would be in violation of Occupational Health and Safety Rules and Regulations.

 I wish to make inquires of you to, addresses of contact personal so I may file complaints against the British Columbia Government and agents of the Canadian Government. My complaints are in regard to the governments, Failure to Comply with Legislative Law, Dereliction of Duties, Conspiracy and Cover up in regard to Public and Employee Endangerment. Documents required under the Workers Compensation Act of British Columbia, Article 179, subsection g, in accordance with the Occupational Health and Safety Rules and Regulations, ( Electrical Safety and Traffic Control), have not been obtained by government on any level with gross misconduct by one Workers Compensation Prevention Officer.

 

 I have issues of Violation of my Civil Rights, Security of Person as life threatening issues on the job site have not been addressed as required under the Workers Compensation Act, Articles 107, 108 and 111.

 

 I have filed complaints to all levels of government to no avail. I have exercised my rights, authority and duties as an employee, an Occupational First Aid Attendant and a Certified Member of the Industrial First Aid Attendants Association of British Columbia. I have the right to compliance with article 179, subsection g, of the Workers Compensation Act of British Columbia.   

 

 I suspect black listing in violation of my Constitutional Rights by all government agents that I have contacted with the exception of the British Government and Her Excellency the Rt. Hon. Michaelle Jean, Governor General and Secretary of State to Canada. No government agents have obtained the documents required to make a decision for or against my complaints.

 

  Again I request addresses to agents and personal that will exercise my right to fair representation and compliance with the W.C. Act and Occupational Health and Safety Rules and Regulations.  In the letter from your Ministerial Correspondence Unit dated Aug. 31/2006 and December 15/2006 I am informed that you provide legal advice, to the federal government and departments and agencies. As such, you are precluded from becoming involved in legal matters of private individuals.

 

 Mr. Toews may I ask, what government agents or departments did you advice that failure to initiate an investigation constitutes violations of the Workers Compensation Act, Human Rights Act, Labour Standards Act, The Canadian Constitution, Canadian Charter of Rights and Freedoms and the North American Free Trade Agreement on Labour Cooperation? Did you advice any Federal Government agent or department to investigate the conduct of the members of the British Columbian Legislature for failing to comply with Legislative Law or did you simply refer me to the Honourable Olga Ilich who took almost four month and two letters from me to refer me to an agent that refused to address my concerns four years ago?

 

 I don’t know who’s jobs you are protecting Mr. Toews but the law states it should have been mine that you should be protecting not government agents and departments that have failed their duties. I voted for Prime Minister Stephen Harper on the pretence that he would up hold the laws and rights of a citizen. I fail to see him address either.

 

 You, sir and the Prime Minister are breaking the Law. If you don’t like me saying so, then I suggest you find a court house.

 

 Prove me right or prove me wrong. That is the Law.
